Information We Collect About You and How We Collect It

The personal information we collect depends on how you interact with us, the products you purchase, and the choices you make. We collect personal information about you from different sources and in various ways.

Information You Provide to Us. ECI collects information you provide directly to us on the Site, via email, or through your communications or interactions with us. This includes, but is not limited to, the following

  • Identifying information, such as your full name, gender, date of birth, and signature.
  • Contact information, such as your home address, telephone numbers, and email addresses.

Information from Other Sources. ECI may receive information about you if you use any other websites affiliated with ECI or from information you post on or submit to the Site, such as on registration screens, and online forms. ECI may also receive information about you from webinars or offline sources such as offline communications and interactions, conferences, or events.  

Information We Collect through Automatic Data Collection Technologies.

As you navigate through and interact with the Site, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:

  • Information Automatically Collected via the Site. When you visit the Site, ECI automatically collects certain technical information from your browser, such as the internet protocol (IP) address used to connect your computer to the internet, browser type and version, time zone setting, browser plug-in types and versions, operating system and platform, and other data about your visit to the Site such as referral pages, date and time of site access, and site visited.
  • Information Collected Using Cookies. Cookies are data files created when you visit a website and those files are stored locally (on your device). When visiting the Site, we may use both session Cookies (which expire once you close your web browser) and persistent Cookies (which stay on your computer until you delete them) to make your experience on the Site more personal and interactive. Information collected may include websites you visited before browsing the Site, pages you viewed on the Site, number of times you accessed the Site, how long you spent on the Site, and other web traffic data. For example, pixel tags (also known as clear GIFs, web bugs, or web beacons) may be used to track the online movements of users of the Site. Promotional materials may include newsletters or other information regarding ECI products and/or events.   • Our Partners. With Software/IT and cloud service providers we use to support our business. We may also share your information with our selected partners in order to conduct business, including conducting audits, performing industry analysis, and evaluating the results of marketing efforts. When you provide information as described above, we may share your information with selected partners (e.g., email newsletter providers) to provide you the requested information.
  • Third Party Advertising. With our third-party marketing service providers and advertising companies, which may use Cookies and other technology to collect information and track browsing activity over time and across third party websites. Other websites may refer traffic or link to our Site and deliver targeted advertisements to you. We do not control these third-party technologies, and their use is governed by the privacy policies of third parties using such technologies.

  • Corporate Transactions. In connection with, during, or upon completion of a merger, acquisition, asset sale, or other business transaction that involves some, or all, of ECI’s assets, data you have provided to ECI may be transferred to a successor/purchaser as part of a transaction.

Updating Your Information. If you need to update or change your personal information, please email us at infoNA@eci-rx.com.

Opting Out of Communications. Our promotional materials include instructions for opting out of receiving further communications. If you no longer wish to receive promotional emails, you may opt out by contacting us with your request at infoNA@eci-rx.com. Please note that even if you opt out of receiving marketing communications, we may still communicate with you regarding an established business relationship, if one has been established. Please allow a reasonable time after reaching out for us to process your request.

Opting Out of Analytics Tools. You may opt out of having your data used by Google Analytics via Google’s Ads Settings, Ad Settings for mobile apps, or any other available means. Please visit policies.google.com/technologies/partner-sites for more information on how to do this.

Adjusting Cookie Settings. Most browsers accept Cookies until you change your browser settings. If you do not wish for the Site to collect your information using Cookies, you can typically disable the use of Cookies (or disallow the use of Cookies on specific websites) by changing your browser settings. However, if you remove or reject our Cookies, it could affect how the Site works for you.

Children Under the Age of 18

Our services are not designed or intended to collect information from children under the age of 18. ECI does not knowingly collect or maintain any information from individuals under the age of 18.

California and Nevada

California Do Not Track Disclosure.

Do Not Track (“DNT”) is a privacy preference that you can set in your web browsers, which allows you to opt out of tracking by websites and online services. We do not currently recognize or respond to DNT signals. For more information about DNT, please see https://www.eff.org/issues/do-not-track.

California Shine the Light.

California's "Shine the Light" law (Civil Code Section § 1798.83) permits users of our services that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. Nevada Privacy Rights.

Nevada residents who wish to exercise their sale opt-out rights under Nevada Revised Statutes Chapter 603A may submit a request at infoNA@eci-rx.com. Please note that ECI does not sell your personal information.

European Data Protection Rights

The EU’s General Data Protection Regulation (“GDPR”) provides EEA individuals with additional rights regarding our use of your personal data as defined under the GDPR. The following sections provide additional information regarding ECI’s use of EEA individuals’ personal data and EEA individuals’ rights under the GDPR.

Legal Basis and Purposes for Data Processing.

We only process your personal data when we have a legal basis for doing so. Specifically, we will only process your personal data as follows:

  • Where our use of your personal data is necessary to perform a contract or contracts that you are a party to, or to take steps that you request before entering a contract. For example, contracts involving the collection and processing of personal information, either for the purpose of performing services under the contract or otherwise;
  • Where our use of your personal data is within our legitimate interests or the legitimate interests of the organization with which we have shared your personal data and we have made sure that your personal data, and your rights in relation to that information, are protected. We do not make automated decisions about you or engage in data profiling.

You are not required to provide any personal data to ECI. If you pre-order or purchase our products or engage or access our services, you are required to provide certain personal data to enable us to perform our obligations. During any required registration for our services or products, you will be provided with information regarding which data elements are required.

Your Rights.

You have choices regarding how we use your personal data. You are entitled to the following:

  • The right to access: You have the right to request copies of your personal data. We may charge you a minor fee for this service.
  • The right to rectification: You have the right to request that we correct any information that you believe is inaccurate. You also have the right to request that we complete information that you believe is incomplete.
  • The right to erasure: You have the right to request that we erase your personal data under certain conditions.
  • The right to object to processing: You have the right to object to our processing of your personal data, under certain conditions. 
  • The right to data portability: You have the right to request that we transfer the data we have collected to another organization, or directly to you, under certain conditions.

In addition, when ECI provides products or services or acts as a data processor, we receive your personal data from third parties as needed to provide the products or services. If ECI is processing your personal data as a data processor, we will refer you to our client for assistance with these requests. We support our clients with responding to requests required by law.

Cross-Border Data Transfers.

ECI is a company based in the United States. The Site is controlled and operated from the United States; however, information collected about you maybe collected, stored and processed anywhere we engage service providers, including outside of the United States. When we transfer and process information about you, we will protect it as described in this Privacy Statement. By using the Site and our services, you consent to the transfer of information to countries outside of your country of residence, which may provide for different data protection rules than in your country.

The European Union Commission has determined that the data privacy laws of the United States do not ensure an adequate level of protection for personal data collected from EU data subjects unless U.S. companies enroll and participate in a self-certification program with the U.S. Department of Commerce known as the EU-U.S. Data Privacy Framework ("Framework"). ECI has not self-enrolled in the Framework. Thus, any such international transfers by ECI will generally be subject to appropriate additional safeguards under standard data protection clauses adopted by the EU Commission or adopted by a supervisory authority and approved by the EU Commission.
